Supreme Court Invalidates NLRB Appointments

Last Thursday, the US Supreme Court decided the National Labor Relations Board v. Noel Canning case and invalidated President Obama’s recess appointments to the National Labor Relations Board.

Because the Court invalidated the appointments, the NLRB did not have enough members to make valid decisions from January 4, 2012 to July 30, 2013, and every decision issued during that time is now invalid. The board has the opportunity to reexamine the invalidated decisions and could decide them in the same way as before.
