Federal Contractors Now Prohibited from Discriminating Based on Sexual Orientation & Gender Identity

On Monday, the President signed Executive Order prohibiting federal contractors, subcontractors, and federally assisted construction contractors and subcontractors from discriminating against employees on the basis of sexual orientation and gender identity.

The order also requires these employers to take affirmative action to employ members of these protected classes, to treat employees without regard to these protected classes, and to include these protected classes in statements of non-discrimination used in solicitations for employment or advancement and AAP reports. Additionally, religion remains a protected class for federal contractors, despite a push by religious groups for a religious exemption to the executive order.
