On February 1, 2016, the EEOC issued proposed rules regarding the annual EEO-1 report. As a reminder, all employers with 100 or more employees must file an annual EEO-1 report, which provides the federal government with information about the race, ethnicity, sex, and job categories of the employer's work force. The report is filed on September 30 of each year based on information compiled from July through September.
Under the new rules, employers will also be required to submit compensation data for its employees. Under the proposed rules, the first report on which compensation data would be required would be the September 2017 report. The EEOC will then compile and publish this data, so employers can use it to analyze the equity of their pay practices. The EEOC will also use the data for enforcing violations of the Equal Pay Act.
The comment period for the rules is currently open and will close on April 1, 2016.
