EEO Data Collections Delayed Due to COVID-19

On May 7, the Equal Employment Opportunity Commission (EEOC) announced that due to COVID-19, it will delay the opening of its 2019 EEO-1 Component 1 data collection, as well as the 2020 EEO-3 and EEO-5 data collections. EEO-1 Component 2, which involves pay data, had previously been suspended.

The EEOC expects to begin collecting the 2019 EEO-1 Component 1 data along with the 2020 EEO-1 Component 1 data in March 2021. Moreover, 2020 EEO-3 and 2020 EEO-5 data is expected to begin being collected in January 2021. The EEOC states that in delaying the collection of data until 2021, it will ensure that EEO filers are better positioned to provide accurate, valid and reliable data in a timely manner.

As a reminder, employers with 100 employees or more during the calendar year and federal contractors with at least 50 employees and who have received a federal government contract of at least $50,000 must file Component 1 of EEO-1 Report every year. EEO-1 Component 1 requires employers to list employees by job category, race, ethnicity and sex.

The EEO-3 survey, known as the Local Union report, applies to Referral Unions with 100 or more employees. The EEO-5 survey applies to public elementary and secondary school districts with 100 or more employees. Both the EEO-3 and EEO-5 survey are conducted biennially in every even-numbered year and require reports categorized by race, ethnicity, and sex.
