New Bill Creates Rebuttable Presumption of Retaliation

Today, Oregon Governor Brown signed Oregon SB 483 which creates a rebuttable presumption that an employer has engaged in unlawful retaliation against an employee or prospective employee if a person bars or discharges an employee or prospective employee from employment or otherwise discriminates against them within 60 days after the employee or prospective employee has engaged in certain protected activities such as making a claim of unsafe working conditions.

This presumption may be rebutted by a demonstration of a preponderance of the evidence.  This law takes immediate effect.
