On December 2nd, the Centers for Medicare & Medicaid Services (CMS) issued a statement explaining that it will halt enforcement of its COVID-19 vaccine mandate for health care workers. This statement comes after a Louisiana federal court granted the preliminary injunction against the CMS mandate. The court ruled in favor of the injunction, stating that CMS’ mandate would lead to irreparable harm against each state.
As a reminder, the CMS mandate requires that healthcare workers at facilities participating in Medicare and Medicaid are fully vaccinated unless a medical or religious exemption applies.
The Louisiana district court’s ruling applies to Oregon and throughout the United States, except for 10 states who are part of a separate CMS injunction. The pause on the CMS ruling will stay in place until the court makes its final decision or it is moved to the Supreme Court.
