To Mask or Unmask—How Will Employers Respond?

As we alerted earlier this month, no later than March 31, Oregon will lift its mask mandate for indoor public places.

You may recall June of 2021 when it was announced that all COVID-19 restrictions would be lifted, only to have them re-imposed again at the end of July. All of this may have you wondering what will happen this time.

You’ve been through this before, right?!

A few things to keep in mind once restrictions are lifted:

  • Employers may choose to require masks in the workplace.
  • Employers may choose to have no mask requirements (subject to certain industry exceptions such as in healthcare settings). However, employees should still be allowed to wear a mask if they prefer.
  • Employers may choose to require masks for certain positions or departments depending on different factors such as how much contact they may have with others or the public.
  • Employers should educate employees about any changes, including updating any facemask policies currently in place.
  • Employers should also educate employees about maintaining a respectful work environment. If an employee chooses to continue to wear a mask, other employees should respect that decision and not engage in any conduct that would violate company policies about workplace respect and communication. For example, employees that choose to wear a mask should not be singled out, teased or questioned about their decision.
  • Employers that choose to no longer require masks should be prepared to address concerns from employees that express discomfort or concern for their health if others are not wearing masks. In these situations, employers may want to refer to the CDC and OHA guidance and information as well as to encourage the employee to wear a mask if that makes them more comfortable.
